Can someone explain about the renewal leases the market rate tenants will get at the Sheffield. Are the rent increases for their new leases going to raise their rents to market rate (who decides what market is) or will their rents increase at rent stabilized amounts or will they increase at somewhere in the middle?

The landlord decides what the rent increase will be (you can bet it will be high). The only caveat is that the increase cannot be unconsciousable - but courts have construed this to mean REALLY FUCKING OUTRAGEOUS as opposed to, Wow, that's a lot of rent. You can bet that Swig will get a expert or two who will tell a court that market comparisons are way up there for a super-lux condo in this location (and let's face it, they are). The holdovers will likely try to fight, but at the end of the day, they will have to bond the amount of the increase with a court PLUS landlord's legal fees as well as be responsible for back rent from the day the lease expired. For example, if a lease expired 1 year ago at $2,500 a month, and the landlord says the new rent is $5,000 a month, the holdover will have to bond the $30,000 in back rent (the excess of the amount they had been paying) - it is unfortunately a losing battle for tenants. A court is not going to limit a landlord's ability to charge market rents (this is America after all) - at some point, the holdover tenants will ask themselves "What the fuck am I fighting for? The ability to pay outrageous amounts in rent forever?" and move.... it will suck if they get stuck paying the landlord's legal fees as well, which could be $100,000 or more...

The conversion was just declared effective with sales prices in excess of $2,000 a foot. This is perhaps one of the most successful/profitable conversions in NYC history!

The intitial posters are all missing the point. The protesters were not the market rate tenants but the 100 rent stabilized tenants!

They were protesting Swig's illegal actions and the deplorable living conditions. Among other issues, they are not letting Swig enter their apartments to place pipes through their living rooms. Why do you think the construction is so far behind schedule? Not to mention the asbetos issue. Also the fact that the Sheffield's high profile neighbor, the Parc Vendome, is challenging Swing in court to deny him the external changes he envisions.

The market rate tenants are the least of his worries....

That is correct.The stabies are the problem.They have thrown so much at Swig,he can't get the building finished.Closings have moved from march to april to may to june.He will be lucky if he closes any deals by years end.Look around the building and it is obvious it's not close to ready.The lobby is only dress up and the driveway is not coming anytime soon.

Swig Equities should disclose to those in the know why, after a multi-million alteration and addition to the lobby, the property pitches on two planes towards the lowest point, which is now the front door.

I am a stabilized tenant at the Sheffield57 - the above posters are market-rate hacks who are looking for a free ride from a successful, wealthy developer. Swig has done nothing short of a marvelous job transforming the Sheffield57 from a unremarkable rental building into a wonderful, luxurious condominium. I am honored to live here - but these holdovers need to get over themselves. The problem is - there are a few market-rate holdovers who think they are entitled to BIG $$$ because of the conversion, and they are trying to become enough of a nuisance that Swig pays them off... they are making false claims using big words like asbestos but really have nothing to complain about - the stabilized tenants are very pleased with the construction, which while not easy to live through, will make our home a wonderful place to live for years to come. Just look at what they have done so far - it looks great!

We just hope that the small number of holdovers stop asking us to contribute to their legal defense fund and move somewhere else where they are legally entitled to stay.

The renovations are impeccable - what a truly wonderful building. Bravo, Mr. Swig, and good luck fighting the ungrateful holdovers! We wish you all the best!

Love the Sheffield amenities... the developer has a good reputation for doing great work and being good guys. The holdovers are going to get jammed for almost seven figures in the landlord's legal fees... even if they stay as renters, if the housing court decision is overturned they will have to pay landlord's legal and then pay market rents (in this market, I wouldn't be surprised to see their rents double). I wonder why the poor saps would risk personal bankruptcy to chase an undeserved windfall.

I disagree with the last poster, I think that building staff has been very honest and helpful. It's just that some people don't want to hear what the staff has to say - i.e., they would rather not deal with construction and continue living in a C plus rental (where we feel special) instead of an A plus condo (where I am afraid I will be treated worse than the condo buyers because they are rich and I am not). That said, I agree with the earlier posters - the holdovers are just looking to get rich quick. I just want the construction to end as soon as possible so I can enjoy the brand new building. It looks very good so far, and I hope everyone realizes the benefits that we will all receive.

There are a few disgruntled tenants who think that this is their big chance to make a quick buck - they are aggressive, ignorant and simply angry people. I would rather they just played the lotto instead - I love the building, I love the staff/management and I plan on being here for years to come.

Well said.My husband and I have been living here 20 years.The building looks and feels like a dump.There is very little activity here,so if they are selling apartments like they say they are then they must be doing it between midnight and 7 am. They quality of the few floors that are done is shody and atrocious.I can't imagine people spending luxury condo money in this building.It really makes no sense.Buyers beware.The hype doesn't come close to the "finished product".

The market rate tenants in a building like this will likely not be able to afford the market rents, so if they are not paying rent, they will be evicted under a non-payment proceeding. Sadly, it is a lose-lose situation for them.

The Sheffield is a winner! My clients love the location/amenities/finishes. You can't get a better value - yes the prices are high, but the comps in the neighborhood (15 CPW, TWC, etc.) make this conversion a relative value. Unsurpassed views in the City.

I have 3 buyers already who have closed and love it! Go see it for yourself.

I must say that as a real estate enthusiast, I have toured and worked on many projects in New York City and the construction at the Sheffield57 is TOP notch. I am befuddled by the negative posts (all of which come from the same IP address, by the way) which claim the construction is shoddy - it is not. It is truly, truly top of the line - I sumbit that the negative posters have some sort of adverse incentive to see this project fail. I have also worked with the individual referenced in the posts above. There is not a more decent, more respected family man in the entire real estate industy and the negative, anonymous posters should truly be ashamed of themselves.

#72, I understand that the appeal was heard a few months ago and the appeals court has not yet released their decision. There are rumors circulating that the housing court decision will be overruled and the decision will be released shortly, but those are just rumors. You can bet that no decision will be released in December as the court will not want evictions to take place over the Christmas/New Years holiday.

Sales are strong at the Sheffield57 - the developer has raised the prices numerous times since the sales office opened and they have outsold (in number of units) every development in the neighborhood. I haven't seen the model apartments, but the word on the street is that the finishes are very very good.

Are people still talking about the court case? I think there are only a handful of market rate tenants left, and in a building of this size, their impact on the development will be insignificant. Even if they stay, their rents will be so high the developer will be happy to keep them on the rent roll.

There is a sewage odor permeating on a number of floors at the newly re-invisioned Sheffield57 (Shitfield57), due to a sewage backup in the "U" apartment line.
We (the tenants) have been told the management is aware of the sewage problem and will address it this coming week. Swig is still illeagally removing asbestos from the building, his people are doing it right this moment as we speak. His people also illegally boarded up the stairwell exits to facilitate the asbestos removal.
The Fire Department(NYFD)came, unboarded the stairwells, a violation (in case of a fire, so the tenants could escape the building), when the NYFD left the building, Swig's workers reboarded up the stairwells. What's that all about?

I am a broker and I understood that the asbestos violation was appealed by the landlord and the violation dismissed by the department of environmental protection. I asked this very question and my client actually went on-line and downloaded a copy of the dismissal. So their is no asbestos issue, other than the previous newspaper articles (funny how the media is quick to write controversial articles but not so quick to retract if the first article becomes factually incorrect).

My client went forward with the purchase and is closing in 2 weeks. It is very funny how the tenants are so unhappy with the building/renovation (not surprising - renovation is tough!) but they don't exercise their right to move somewhere else. The tenants should ask for a payout from the developer - they are probably in-line to collect some real $$$.

we signed a contract back in may, with a promise of closing in august/september. it is now almost november and they still cant get the TCO. anyone else having the same problem at the sheffield?
we actually did the walk through already. apartment is in great shape, but they did not change the windows as promised. they are now saying that they will be changed in the next 6 months, after we have had already moved in.

We are waiting for the TCO, and we are told it should be the end of this week. Our apartment looks better than we thought it would - the finishes are truly wonderful. We knew the windows would be installed after we moved in, so this was not a surprise. What do you think of the lobby? I really love it - I feel like I am walking into a grand hotel everytime I walk into the building.

I know what you mean about the delay. But this is my 3rd "new construction" purchase and my first two purchases had far longer delays than the Sheffield and ended up not as good as the model apartment. The Sheffield actually looks like it is going to be as good as advertised - I bought here because of the location, views and finishes and reputation of the developer - if and when we close, I can't wait to move in.

As far as the asbestor violation goes, The violation was in the wrong name Swig Equities instead if 322 west 57 owner llc.
So Swig got off on a technicality.
But the DEP WILL bring the case back.

Also some buyers have told me that the floors squeak when you walk on them.
potentual buyers might want to check this in their units. The wooden floors are NOT flush with the concrete flooing. they are suspended slightly.

then why do they keep running the advertisements with the driveway running between 56 and 57 street when its very well known to him that its public plaza space that needs permission from the NYC planning commission ?
not only hasnt he applied for the driveway after all this time but he probably wont get it .

There are 37 of us rent stablized tenants who couldn't be happier with the renovation of our building from a post-war rental to a state of the art luxury home. We couldn't be happier.

We just don't like YOU trying to mess with our home - we love it here, we plan to stay for a long, long time (way past when your market rent expires and the judge throws you out). Go back to trying to make a living the HONEST way as opposed to trying to pickpocket someone else who is doing good for us tenants. Have you no shame?

And stop asking us to contribute to your LEGAL FEES. We don't care.

We have been offered every accomodation in the world during this construction period - but we all see the end result - a wonderful luxury home for under $1,500 a month. We are LEGALLY entitled to be here. You know YOU are not - we all know who you are and we silently curse you everytime we see you in the elevator and think that you are foolish and a joke. That's what you are - a JOKE.

We will continue to live in this wonderful, wonderful building LONG AFTER you are forced to move to another building - probably in Statan Island. Shame on you, shame on your family, and G-D bless the fact that I get to live in this wonderful building. I am entitled to be here, all 37 of us are - and those that choose to fight for a 'payout' should be ashamed that they were raised to pick the pocket of others in order to turn a buck.

#109 and #110 - I am a happy rent stablized tenant at the Sheffield and I love the renovations to my building and I intend to stay here a very, very long time. I know that the market rent tenants who are trying to scam their way to a few bucks will be long gone while I continue to enjoy my rent stablized lease and the "newly envisioned" Sheffield57. Of course my new building and all the wonderful amenities are not yet complete - that is why it is a RENOVATION. You can't just snap your fingers and renovate a building. But the work they have done so far is top notch and looks wonderful. The majority of rent stablized tenants could not be happier. Sure, the construction is a pain, but long-term, it is worth every inconvenience for the great new building we will soon live in. The market rate losers cannot accept that we have this great building to live in and they get nothing except for the pleasure of packing up their things and moving to somewhere they will be legally entitled to stay. Tough. The market rate tenants are fools and a joke. The Happy Stabilized 37 love our new building and WE ARE HERE TO STAY!
